Re: Schools--Elections of Trustees in Consolidated Districts

Dear Mr. Jones:

Attorney General Allain has received your letters of request dated July 23, and August 4, 1981, and has assigned them to me for research and reply. Because of the length of your inquiries they are attached rather than being typed herein.

It is our understanding that Bolivar County, in which Shelby, Mississippi, is located, contains six consolidated school districts. Therefore, we respond to your inquiry assuming you are a trustee of a consolidated school district.

Senate Bill 2189 passed by the 1981 Legislature altered the time and manner of elections for trustees of consolidated school districts and was approved on July 31, 1981, by the U. S. Department of Justice under upon5 of the Voting Rights Act of 1965, as amended and extended. Section 37-7-221 (as amended by the 1981 Legislature in S. B. 2189) recites as follows:

The election of consolidated or consolidated line school district trustees shall be held in the manner provided for in Sections 37-7-223 to 37-7-229 rather than the method now provided by Sections 37-7-209 to 37-7-219.

Section 37-7-223 (as amended by the 1981 Legislature in S. B. 2189) provides as follows:

All elections of consolidated or consolidated line school district trustees shall be held on the first Tuesday after the first Monday in November of each year in the same manner as general state and county elections are held and conducted.

Therefore, elections for trustees of consolidated school districts will be held in November rather than March. If this office can be of benefit in the future, please do not hesitate to contact us.
