Dear Mrs. Shirley:

Attorney General Allain has received your letter of request and has assigned it to me for research and reply. Your letter states:

"Four persons qualified with the Hinds County Circuit Clerk to run in the August, 1983, pri- mary. However, those persons did not pay a qualifying fee to the Hinds County Democratic Executive Committee.

"Can we legally accept the fees at this time from those persons who failed to pay by the June 3rd deadline?

We would appreciate your early response so we can prepare our official ballot."

In response to your inquiry, please see the enclosed copy of an opinion addressed to Honorable Paul O. Eastridge, dated June 20, 1983.

In summary, that opinion states that county executive com- mittees have no authority to place names of persons who have not made timely payments of the required qualifying fees on the ballot for the primary elections.
