Dear Mr. Pennebaker:

Attorney General Pittman has received your opinion request and assigned it to me for research and reply.

Your request states:

"I respectfully request an opinion from your office as to whether a person convicted of receiving stolen property under Section 97-17-69, Mississippi Code of 1972, has been disenfranchised under Section 241, Mississippi Constitution of 1600, Section 23-5-35, Mississippi Code of 1972, or any other law."

For a full discussion of this issue, please read the attached opinions: Eloyce Richardson dated October 31, 1985, Maurice Bain dated October 23, 1985, Glen Fortenberry dated April 10, 1984, Ted Lambert dated February 26, 1981, James Taylor dated July 15, 1974, and J. L. Mathis dated June 26, 1974.

The Office of the Attorney General holds the opinion that a person convicted of receiving stolen property is not disenfranchised.

Yours very truly,

EDWIN LLOYD PITTMAN, ATTORNEY GENERAL
