Re: Justice Court Judges and Constables must reside in the District in which they choose to run for election

Dear Mrs. Nail:

Attorney General Edwin Lloyd Pittman has received your letter of request and has assigned it to the undersigned for research and reply. In your letter you state:

It has come to my attention that an emergency ruling from your office is necessary to clear any understanding as to whether a constable or justice court judge must reside in the district and voting precinct in which they run for that particular office. As the deadline to qualify is Friday, June 5, 1987, at 5:00 p.m., I need an expedited ruling on this matter for both offices.

As per our telephone conversation on this date, I am sending this written request by mail.

After a thorough review of 171 of the Mississippi Constitution of 1890 and all other applicable statutes, this office has reached the opinion that individuals seeking the office of Justice Court Judge or Constable must reside in the district in which they choose to run for election, i.e. Justice Court Judge or Constable.

Very truly yours,

EDWIN LLOYD PITTMAN, ATTORNEY GENERAL
