Dear Mr. Monroe:

Attorney General Mike Moore has received your request for an official opinion and has assigned it to me for research and reply. In your letter you ask whether an elected county election commissioner may also serve as an appointed municipal election commissioner.

We have previously opined that there are no statutory provisions that would prohibit a county election commissioner from also serving as a municipal election commissioner; however, we do not speak to the propriety of an election commissioner holding such dual offices. Also, please note that an individual holding such dual positions should carefully separately document the hours they are working for each governmental entity so as not to receive double pay for the same hours worked.
