Re: Residency requirements of justice court judges

Dear Judge Williamson:

Attorney General Mike Moore has received your letter of request for an official opinion and has assigned it to me for research and reply. Your letter has been attached for reference and is incorporated herein. Your specific question is:

Whether a Justice Court Judge must reside in the district he intends to serve?

This office has previously opined that as a general rule that a justice court judge must reside in the district he intends to serve. We also opined that the holding by the Lauderdale County Circuit Court in Smith v. Lauderdale County Democratic Executive Committee, #2244 (July 10, 1987), that a justice court judge is required to be a qualified elector of the county as opposed to the district from which he is elected only applies to the Tenth Circuit Court District of Mississippi.
