Re: Absentee balloting

Dear Mr. Myrick:

Attorney General Mike Moore has received your request for an official opinion and has assigned it to me for research and reply. Your letter states:

Jones County will be conducting a county-wide special election on Tuesday, July 7, 1998.

As I understand, the Governor has declared July 6 as the Fourth of July Holiday, and our Jones County courthouse will also be closed that day.

Normally, the deadline for absentee balloting in the Clerk's office is the noon hour on Saturday prior to the Tuesday election.

Will we be required to be open on July 4 (Saturday) from 8 to noon in regard to this election? If not, then when would be the deadline for anyone voting absentee in the clerk's office?

It is the opinion of this office that the deadline for absentee balloting should be the Friday prior to the election on Tuesday since the Saturday before the election is a holiday.
