Dear Ms. Youngman:
Attorney General Mike Moore has received your letter of request and assigned it to me for research and reply. Your letter states:
In my capacity as city attorney for the City of Belzoni, Mississippi, the following question has arisen. Under Mississippi Code Annotated Section 23-15-14, if a person moves into Humphreys County and registers to vote with the Circuit Clerk's office and that person is not then a resident of the City of Belzoni but later moves into the City and does not notify anyone and that person attempts to vote via affidavit ballot is the affidavit ballot a valid vote?
In response to your inquiry, please see the enclosed copy of our opinion to Billy B. Bowman, dated January 26, 2001. In addressing a similar factual situation, we said that an affidavit ballot cast by a person who is a registered county voter and subsequently moves into the corporate limits of a municipality within that county but fails to file a change of address or a new registration application would have to be rejected in accordance with Sections 23-15-573 and 23-15-11. This remains the opinion of this office.
