Advisory Opinion Text

The Honorable John R. Ashcroft

No. 164-2023

State of Kansas Office of the Attorney General

March 7, 2023

Missouri Secretary of State James C. Kirkpatrick State Information Center 600 West Main Street Jefferson City, MO 65101 Dear Secretary Ashcroft:

This opinion letter responds to your request dated February 24, 2023, for our review under § 116.334, RSMo of a proposed summary statement prepared for the petition submitted by Elad Gross, 2024-063. The proposed summary statement is as follows:

Do you want to amend the Missouri Constitution to:

• replace term limits of eight years in the House and eight years in the Senate with an overall term limit of sixteen years total in the legislature;

• prohibit the legislature from proposing any measure restricting Missourians' power of initiative; and

• forbid the legislature from changing any voter-initiated law without a referendum at a general election or three-quarters' consent in the House and in the Senate, unless more than seven years have passed since voters approved the law?

Pursuant to § 116.334, RSMo, we approve the legal content and form of the proposed statement. Because our review of the statement is mandated by statute, no action that we take with respect to such review should be construed as an endorsement of the petition, nor as the expression of any view regarding the objectives of its proponents.

Very truly yours,

ANDREW BAILEY Attorney General
