RE: Time

I have your inquiry of March 10, in which you request our opinion as to whether the time for holding elections under various statutes is to be Mountain war time or Central war time. You point out that some of the cities in the eastern part of the state are operating under the old time and have not adopted the time which the Legislative Assembly fixed by statute at its last session.

In my opinion, the legal time in North Dakota is the time fixed by the Legislative Assembly. Where time for holding an election is fixed by law, the time indicated is the time fixed by the Legislative Assembly and not the time which some of the cities of the state may adopt. In other words, the hours for the opening and closing of polls fixed by statute are to be determined under the legal time in North Dakota, which is now Mountain war time.
