In Mandamus and Prohibition. On motion to intervene of Clarkshaw Reserve I, L.L.C. Motion granted. Relator's motion for leave to file second amended verified complaint denied. Motion to dismiss of Delaware County Board of Elections granted as to the second and third claims for relief. Partial motion to dismiss of Liberty Township Board of Trustees, Shyra Eichhorn, and Bryan Newell granted as to the fourth and fifth claims for relief. Liberty Township Board of Trustees, Eichhorn, and Newell dismissed as respondents to this action. Clarkshaw Reserve I, L.L.C.’s motion for partial judgment on the pleadings denied as moot.
Sua sponte, alternative writ granted as to the first claim for relief in the amended complaint. The following briefing schedule is set for presentation of evidence and filing of briefs: relator's evidence and merit brief shall be filed on or before Friday, August 6, 2021; respondent and intervening respondent's evidence and merit brief shall be filed seven days after relator's evidence and merit brief are filed; and relator may file a reply brief five days after respondent and intervening respondent's evidence and merit brief are filed. No requests for extension of time shall be filed, and the clerk of the court shall refuse to file any requests or stipulations for extension of time.
